Terms and conditions of the contract of the carriage   

  1. These conditions will be applicable to the services contracted in the absence of specific agreements. SEUR has at its disposal in the fee book and on the seur.com website, the conditions of each service or product that the sender accepts and is aware of.
  2. The contractual data on the nature of the goods, name and address of the addressee and sender are provided by the latter under their own responsibility and are not checked by SEUR, except at serious risk or by order of the competent authority.
  3. Services will be provided from Monday to Friday, except on Saturday mornings for those shipments for which the complementary services Saturday Delivery and/or Saturday Collection are contracted. Holidays and Saturdays are excluded from the timetable. S-10 services may be delivered before 11:00 a.m. in towns more than 50 km from the SEUR central office of destination. If the service is not collected within 24 hours of the request for reasons attributable to SEUR, the maximum compensation payable will be 10% of the freight. If it is not possible to identify all the packages at the time of collection, the quantity stated on the departure manifest will not be considered valid until each of the packages has been identified by means of the devices installed on our platforms.

Delay in delivery   

In the event of non-compliance with the agreed delivery time, the compensation shall not exceed the price paid by the customer. If it is partial, compensation shall be paid on a pro rata basis. Failure to meet the delivery deadline will not be considered to be caused by the absence or change of address of the addressee, unknown addressee or address, non-payment of postage, substitutes or refunds, closure due to holidays, late deliveries on the second delivery attempt, force majeure or unforeseeable circumstances or other causes not attributable to SEUR. Excluded from this guarantee are goods sent “to be collected” at the SEUR address or warehouses at destination. SEUR will not be responsible for delivery delays in shipments to the Canary Islands, Balearic Islands, Ceuta and Melilla when caused by reasons beyond SEUR’s control (delays by airlines, shipping companies, etc.).

Enhanced liability coverage   

In the absence of an express declaration of the value of the goods transported, SEUR’s maximum liability for loss or damage is limited to a maximum of 33 euros per kilo of consigned weight, with a maximum compensation limit of 1,800 euros per shipment (MULTIBOX (MB) and MULTIDOC (MD) will be 33 euros per envelope). For the aforementioned purposes of coverage of the aforementioned indemnity, 8% will be charged on the freight price for the aforementioned improved coverage (minimum 2.02€ per shipment), except for MB, MD and MULTIPACK (MP) products, which are included in the price. Not applicable to TÚMANDAS and SEUR BICI services limited according to Law 15/2009. No compensation will be paid for damage to perishable goods as a result of the temporary action if the goods were delivered within the agreed period.

Declared value insurance   

The customer has the option of taking out a supplementary insurance policy for the transport, which covers, with a declaration of actual value, any damage to the goods up to this value. The cost of this insurance shall be 1.4% of the declared value (minimum 4€). In this case the surcharge provided for in paragraph 5 shall not apply. The above does not exempt the customer from the requirement to present documents proving the actual value for the purpose of compensation. The maximum limit of cover shall be 3.000€ per shipment.
REFUND SERVICE: A charge of 5.60% of the value of the reimbursement (minimum 7.44€, maximum 145.32€) is set as the amount of the reimbursement service, to be added to the fee. The aforementioned charge includes collection management and insurance against loss or damage to the goods up to the total amount of the refund. Temperature controlled services are excluded. If the shipment is carriage forward, payment of the carriage and reimbursement must be made at the time of delivery to the addressee.
WEAPONS: The service contains a 6% charge on the fee (minimum 1.73€) which includes insurance against loss or breakage of the goods up to a maximum value of 1,500€, subject to proof of value.
 

Exemption   

SEUR may reject packages that are poorly packaged or identified for transport, that do not have the necessary documentation or whose characteristics do not coincide with those declared by the customer. SEUR may make the acceptance of packages subject to the acceptance of the reservations stated on the delivery note, and shall not be liable for damage resulting from insufficient packaging for transport. The transport of packages and objects whose content is contrary to the Law or whose transport is subject to special requirements or provisions (weapons, money, funds or effects, toxic, inflammable or dangerous materials, explosives, other goods subject to ADR, etc.) is excluded, and is the sole and exclusive responsibility of the sender, who expressly exonerates SEUR of any liability in this respect. The transport of goods whose length exceeds three meters is excluded.

Delivery   

Delivery of the shipment will be made to the address designated by the sender with up to two attempts (except in periods of peak production, with one), and the following at points in the SEUR network, except in the repeated absence of the recipient or when the weight, volume or characteristics do not allow a single person to handle it, in which case, prior notice will be given at the street door or at the SEUR central office at the destination. In the absence of the addressee, notice will be left of the delivery attempt and how to arrange delivery. 52.38€ will be charged for those services that exceed the mere collection and delivery of the shipment or that involve an unusual procedure. In the case of the purchase of packaging from SEUR, the final holder will be responsible for the delivery of the packaging waste and its correct management.
The non-delivery of the shipment due to the absence or refusal of the consignee, deficiency of his data or non-payment of the amounts derived from the carriage shall be the responsibility of the sender, who shall be obliged to bear, at his own expense, all the costs caused by this incident (deposit, carriage, customs insurance, return to origin…)

Necessary requirements   

In order to proceed with the delivery of the shipment, the delivery note must be signed by the addressee. In the event that the recipient refuses to sign the delivery note, SEUR will be exonerated from all liability.

Sender   

The sender, shipper and/or exporter authorises the customs representative SEUR España Operaciones S.A. as the fully authorised agent to manage customs clearance when this is necessary, as well as to appoint another customs agent for this purpose. The sender is obliged to provide all the documentation and information necessary to comply with customs, customs and security formalities prior to acceptance of the shipment. SEUR is not obliged to examine or check whether the aforementioned documentation and information is accurate or sufficient, this being an extra- contractual declaration for management purposes. The sender undertakes to indemnify SEUR for any penalty, expense or cost incurred by SEUR in customs clearance for any cause not attributable to SEUR.

Claim deadline   

The deadlines for making a claim for damage or faults in the shipment will be 7 days from delivery or in the same act of delivery on the delivery note if they can be seen externally, in accordance with the provisions of the Contract of Carriage of Goods by Land and the CMR Convention (except for international air shipments, 14 days). In the case of delays, written reservations must have been made to SEUR within 21 days of delivery. Actions derived from the transport contract expire after one year. Complaints must be made by any written means. In the event of breakage, it is essential that the customer keeps the packaging of the damaged goods and shows it to SEUR staff.

Telematic tools   

SEUR may use new telematic tools to collect the customer’s signature in order to accredit the collection and delivery of the shipment, which the customer accepts without reservation.

International delivery   

The same national restrictions apply (point 7) and, in addition, the shipment of liquids of more than 1 litre, gases, antiques and cataloged works of art, animals and perishable goods is prohibited in international transport. A supplement of 0.30€ per shipment is applied as a Security Fee.
CARRIER LIABILITY: In the event of delay in delivery for all international services, point 4 shall apply. With regard to loss or damage to shipments as a result of transport, compensation is limited to a maximum of the following amounts according to the type of service contracted:
  • COURIER: Documents, 300.51€ per shipment. Samples, 1.202,02€ per shipment.
  • NETEXPRESS: 8.33 SDR (special drawing rights) per kg, in accordance with the CMR Convention.
  • CLASSIC: 520€ per consignment.

Cubication   

Se aplicará cubicaje en aquellas expediciones que:
- Tengan como origen o destino las franquicias de Baleares (por vía aérea), Canarias, Melilla e Islas Portuguesas.
Cubiaction will be applied in those expeditions that:
  • Have as origin or destination franchises of the Balearic Islands (by air), Canary, Melilla and Portuguese Islands.
The volume of the shipment shall be cubed in accordance with the following parameters:
  • In the maritime service with the Canary Islands, Melilla and Portuguese Islands, at a rate of 333 Kg/m3
  • In the international Courier and Netexpress services, at a rate of 200 Kg/m3
  • In the rest of the services, at a rate of 167 Kg/m3

Collection and delivery conditions   

  • URBAN CENTER: For the purposes of pricing services and re-deliveries, only provincial capitals and towns that appear in the table of destinations will be considered urban centres. All other towns will be considered as “DELIVERIES OUTSIDE THE URBAN AREA” for the purposes of fees. In the event that SEUR has to modify the franchise on which a specific town depends, there will be a consequent variation in the price of re-delivery.
  • DELIVERIES OUTSIDE THE URBAN CENTRE: For deliveries outside the urban area, the price of the shipment will be increased by the re-dispatch fee corresponding to each service. 
  • OUT-OF-URBAN CENTRE PICK-UPS: For pick-ups outside the urban area, the price of the shipment will be increased by the re-dispatch fee corresponding to the SEUR 24 service.
  • PICK-UPS IN MADRID: For pick-up services of the SEUR 24 service carried out in Madrid (urban centre) the price of the shipments will be increased by 1,79€ for shipments up to one kilo, and 5,38€ for the rest of the shipments, plus VAT.

Imports   

The destinatary/import authorizes SEUR to manage the custom office needed for the import and release of their goods, as well as to carry out all those procedures that are mandatory in accordance with the provisions of the Resolution March 5, 2015 of the General Directorate of the State Agency of tax administration, in relation with both the register and the management of custom clearance (office) authorities.
The destinatary/import guarantees the veracity of the information and the documents given for the custom office, exempt SEUR of any responsibility derived from the falsehood of it.

Cancellation of shipments   

According to article 103 of the Consumers Law, the client could use the right to desistir the service through this link, without justifying the decision and without any penalization, as long as it is done before the carrier collects the goods in the sender address.
